General End-customer Terms and Conditions of Business of PM-International AG (Switzerland)

1. Scope

These General Terms and Conditions of Business (hereinafter “GTCs”) apply to all products which you as a customer purchase from PM-International AG (Switzerland) (hereinafter “PM-International”). Products are sold and delivered only in accordance with these GTCs.

PM-International performs its services professionally and with due care in accordance with these GTCs and the other contractual provisions published on its website (data privacy statement, etc.). Prices and ranges are subject to change without notice. Errors and misprints excepted. All quotations are non-binding.

2. Conclusion of the contract

By placing an order, you expressly consent to these GTCs. Receipt of an automatically generated order confirmation does not constitute a promise that the ordered products are actually available and/or can actually be delivered. The confirmation merely indicates that PM-International has received your order.

PM-International reserves the right to limit the quantity of products that can be ordered.

You can order a monthly subscription from a PM business partner. In this case, you are tied to your existing business partner for 6 months after the last delivery. You can register yourself as a business partner with a business partner other than your existing one at the earliest 6 months after the last delivery.

3. Prices

From the Thayngen service centre, the prices given on the PM-International website are inclusive of value-added tax and exclusive of the applicable shipping costs and any surcharges for small quantities.

4. Delivery

PM-International will fulfil the order within a reasonable period of time. PM-International reserves the right to fulfil orders only to the extent that there are actually goods available in stock. In the event that ordered products are not in stock, the purchase agreement for those products comes into being only if PM-International notifies you within 3 working days of receipt of the order that the goods will be delivered. If ordered products will definitely not be delivered, PM-International will reimburse all amounts that you have already paid. If, in addition to the out-of-stock products, in-stock products were also ordered, the delivery of those in-stock products is unaffected by the foregoing provisions.

If products are damaged in transit or delivered incorrectly, PM-International will replace them free of charge as long as notification of this damage or incorrect delivery is provided within 8 days of receipt of the products. The damaged or incorrectly delivered products must be returned immediately and at the latest within 14 days of receipt. If notification of the defects is not provided within the specified time, warranty claims are forfeited as a result. The replacements are delivered once PM-International has received the returned products.

The delivery times stated are non-binding. Delivery delays do not entitle the customer to a reduction in the price or compensation.

5. Reservation of title

PM-International retains ownership of the ordered products until payment has been made in full.

6. Payment, due date, late payment

The ordered products can be paid for by direct debit, cash on delivery, invoice or credit card. PM-International reserves the right to exclude certain types of payment in specific cases. It is not possible to pay for products by sending cash or cheques. If lost, PM-International will not accept any liability. If you are late in paying, PM-International reserves the right to bill reminder charges.

7. Satisfaction guarantee

PM-International grants its customers a 30-day satisfaction guarantee: if you are not satisfied with the products you have purchased, you have the right to withdraw from the purchase agreement by notifying PM-International in writing at the address below within 30 days of delivery and to return the products for a full refund of the purchase price. To observe the specified timeframe, it is sufficient that the notification be dispatched in good time (date of the postmark).

Products are returned at your own expense. The purchase price is refunded within 30 days of the returned products being received at the address above.

8. Data privacy

You acknowledge the PM data privacy statement published on the website www.international.com and consent to your data being processed in accordance with the PM data privacy statement.

9. Applicable law

The General Terms and Conditions of Sale and Delivery and the purchase agreements entered into under those Terms and Conditions are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
